AIX Secure SPV Ltd (in Official Liquidation): information for investors

On 30 October 2026, the Grand Court of the Cayman Islands placed AIX Secure SPV Ltd into official liquidation. Justice David Doyle refused the company's application to adjourn the hearing so it could pursue its own restructuring proposal.

AIX Secure SPV Ltd is the Cayman-registered issuer of fixed-income notes linked to AIX Investment Group. The petition was brought by an investor and supported by a group of creditors, including clients of ALBM Excello Law, represented by Barrister Sebastian Gollins of KSG Attorneys.

This page explains what the court ordered, what happens next and what AIX investors can do now.

What the court ordered

-. AIX Secure SPV Ltd is in official liquidation, and control of the company has passed from its director to joint official liquidators appointed by the court

-. The court appointed Angela Barkhouse of Kroll (Grand Cayman) and Michael Byrne of Kroll (Dubai) as joint official liquidators, acting jointly and severally

-. The legal costs of the petitioner and every supporting creditor will be paid from the company's assets after the liquidators' own costs and before the claims of ordinary unsecured creditors, assessed on the indemnity basis if they cannot be agreed with the liquidators

-. The liquidators may bring proceedings in the DIFC Courts and the onshore Dubai courts and take over existing DIFC claims against the company

-. The liquidators may seek recognition of their appointment in the UAE, the United Kingdom and Switzerland

What happens next

Proceedings against the company are now stayed. The liquidators will secure the company's assets, investigate its affairs and the wider AIX Group structure, and write to creditors.

A formal proof of debt process for registering claims will follow, and the liquidators will notify creditors of any court deadlines.

It is too early to say what creditors may recover. The liquidators will investigate and report to creditors.

What AIX investors should do now

1) Do not contact AIX directly. The liquidators have asked creditors to deal with their office: AIX@kroll.com

2) Check which AIX entity issued your investment. Contracts issued by AIX Secure SPV Ltd (Cayman) and by AIX Investment LLC (Dubai) may raise different jurisdictional questions and need separate advice

3) Gather your documents: investment contracts, proof of the original payments, records of any payments or returns received, and correspondence with AIX, Harneys or the liquidators

4) Prepare your proof of debt now and file it as soon as the liquidators call for claims

5) Attend the first creditors' meeting and consider standing for the liquidation committee, which oversees the liquidators' strategy, investigations and costs

FAQ

What happened to AIX Secure SPV Ltd?

The Grand Court of the Cayman Islands ordered the company into official liquidation on 30 October 2026. Court-appointed liquidators from Kroll now control the company, its records and its assets.

Who are the liquidators?

Angela Barkhouse of Kroll (Grand Cayman) and Michael Byrne of Kroll (Dubai). Their office can be reached at AIX@kroll.com.

I invested with AIX. Am I a creditor?

If you hold an investment contract with AIX Secure SPV Ltd, you can submit a claim in its liquidation. If your contract is with AIX Investment LLC in Dubai or another AIX Group entity, your position may be different and needs separate advice.

What is a proof of debt?

It is your formal claim to the liquidators. It states what the company owes you and attaches the evidence. The liquidators decide whether to accept it, and accepted claims share in any money recovered.

What documents will I need?

Your investment contracts and related documents, evidence of the original investment payments, details of any payments or returns received and any other correspondence about your investment.

Do I need to start a lawsuit before I can claim?

No. Submitting a creditor claim in the liquidation does not require you to have started any legal proceedings.

Can I submit a claim myself?

Yes. You can submit a claim to the liquidators without appointing a lawyer or joining a creditor group. Legal help is useful where you hold several contracts, received some payments or returns, or are unsure which AIX company issued your investment. We can reconcile your contracts and payments, prepare and file your proof of debt, and deal with the liquidators’ questions for you.

Will I get my money back?

It is too early to say. The liquidators will trace and recover assets, investigate the company's affairs and report to creditors on what may be available.

What does the priority costs order mean?

The court ordered that the legal costs of the petitioner and the supporting creditors be paid from the company's assets ahead of the claims of ordinary unsecured creditors, after the liquidators' own costs. The order covers the parties who brought and supported the petition. It does not cover the legal fees of investors who instruct a lawyer now.

Why do the UAE courts matter?

Many AIX investors live and invested in the UAE, and the UAE courts will be central to tracing and recovering assets. The court order allows the liquidators to act in the DIFC Courts and the Dubai courts.

What is the liquidation committee?

A small group of creditors who oversee the liquidators' strategy, investigations and costs. Investors can put themselves forward at the first creditors' meeting.

How ALBM Excello Law can help

ALBM Excello Law and KSG Attorneys work together on the AIX recovery.

ALBM Excello Law advises on the UAE and wider Middle East, including the remedies and recovery steps available in the region. KSG Attorneys handles the Cayman Islands, where any applications or proceedings in the court must be taken by Cayman counsel. The two firms coordinate to avoid duplicated work.

If you instruct us, we will:

1.. Identify the AIX entity that issued each of your investments

2.. Review your contracts and payment records and prepare a contract-by-contract schedule of capital invested, payments received and amounts outstanding

3.. Advise on the liquidation process and deadlines in each jurisdiction

4.. Prepare and submit your proof of debt and deal with the liquidators' enquiries

5.. Keep you informed and, where needed, advise on and take legal steps to protect your position

We act for you individually, never for the company, the liquidators or an investor group. Where we represent several creditors, you will receive a consent form explaining how we keep each client's claim, instructions and information separate. Any sharing of costs for common work is agreed with you in writing in advance.

ALBM Excello Law is registered with the DIFC Courts and has full advocacy rights before the UAE Civil Courts. The team on this matter includes Sujith Mathew and Richard Imran Ding of ALBM Excello Law and Fraser Griffiths of Excello Law UK.
